I refer to the news report by The Malaysian Muslim Lawyers' Association through it's President Muhamad Hisham Marzuki dated 2 September 2024, and note the intellectual dishonesty, religious intolerance and wilful ignorance of Malaysia’s constitutional and legal history.
Jabatan Kemajuan Islam Malaysia (JAKIM), since 1st January 1997, has only ever been a department under the Prime Minister’s Department. It is therefore a creature of policy, not law. Nowhere does the Federal Constitution expressly constitute JAKIM. JAKIM’s existence was only ever meant to be a coordinating office, not a billion ringgit measure by the Prime Minister to have the effect of politically propagandizing a religion held sacred by a majority of Malaysia and not believed in by its minority.
We know this, and can say this with absolute certainty, because this was clearly stated in the Constitutional Proposals for the Federation of Malaya, presented by the Secretary of State for the Colonies to the English Parliament in June 1957,:
“Religion of the Federation
57. There has been included in the proposed Federal Constitution a declaration that Islam is the religion of the Federation. This will in no way affect the present position of the Federation as a secular State, and every person will have the right to profess and practise his own religion, and the right to propagate his religion, though this last right is subject to any restrictions imposed by State law relating to the propagation of any religious doctrine or belief among persons professing the religion of Islam.
…
60. If it is found necessary for the purposes of co-ordination to establish a Muslim Department of Religious Affairs at federal level, the Yang di-Pertuan Agong will, after consultation with the Conference of Rulers cause such a Department to be set up as part of his establishment.”
Indeed - that JAKIM is not set up as part of the Yang di-Pertuan Agong’s establishment for the purposes of co-ordination, but is set up under the Prime Minister’s Department for “development” of a religion - already demonstrates that the Prime Minister and his Government is functioning under an error; respectfully, a billion ringgit error.
Malaysia, a multi-religious and multi-racial country, cannot be united, free and democratic if the doctrines, beliefs and practises of one religion is forced, through Governmental policy, on those who do not believe in that religion. On the contrary, it will only produce feelings of ill-will and enmity between Malaysia’s different religious groups. What more when a billion ringgit budget is channelled from the income taxes of Buddhists, Christians, Hindus, Sikhs, Taoist and Confucionists, for apparent “development” of a religion they do not even believe in. This is tragic, and an embarrassing display of insecurity by the Prime Minister and his Government. In a 21st century world, these Malaysians imagine that schools, roads and hospitals would readily be built with that sum of money, particularly for those in rural Malaysia, instead of being wasted on pointless political propaganda.
